EasyVitals Terms and Conditions

Effective date: June 19, 2026

These Terms and Conditions ("Terms") govern your access to and use of the EasyVitals mobile application, related widgets, features, content, websites, and associated services (collectively, the "Service").

For legal and operational purposes, "EasyVitals," "we," "us," and "our" mean the individual or legal entity identified in the app listing, website, or other official EasyVitals notice in effect at the time of your use of the Service ("Operator"). As of the effective date above, questions about these Terms may be sent to support@easyvitals.app.

By clicking, tapping, or otherwise affirmatively indicating acceptance of these Terms where the Service presents that option, or by downloading, installing, accessing, or using the Service after being given notice of these Terms, you agree to be bound by them. If you do not agree, do not use the Service.

1. Eligibility

You may use the Service only if:

• you have the legal capacity to enter into a binding agreement;
• you comply with these Terms and all applicable laws; and
• your use of the Service is not prohibited under applicable law.

If you are using the Service on behalf of an organization or another person, you represent and warrant that you are authorized to bind that party to these Terms.

The Service is not directed to children under 13, and you may not use the Service if doing so would violate applicable minimum-age or digital-consent laws in your jurisdiction.

2. App Store Distribution

If you downloaded the Service from Apple's App Store, you acknowledge and agree that:

• these Terms are between you and EasyVitals, not Apple;
• Apple is not responsible for the Service or its content;
• your right to use the Service is subject to any applicable usage rules set forth by Apple;
• Apple has no obligation to furnish maintenance or support services for the Service;
• Apple is not responsible for addressing claims relating to the Service, including product liability, legal compliance, or consumer protection claims; and
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.

To the extent these Terms do not address a matter required by Apple's mandatory App Store terms, the applicable Apple default terms and usage rules will continue to apply.

3. Account and Authentication

The Service is designed around Apple ecosystem features and may require an Apple ID, Sign in with Apple, iCloud / CloudKit availability, and, for some features, Apple Health permissions or other Apple-managed services. If those services are unavailable or revoked, some or all Service functionality may be unavailable.

You agree to provide accurate information where the Service allows you to do so and to maintain the security of your device, Apple account, and credentials.

You are responsible for all activity occurring through your account or device except to the extent caused by our breach of law or these Terms.

We may suspend or restrict access if we reasonably believe your account or the Service is being used unlawfully, fraudulently, abusively, or in a way that threatens the security or integrity of the Service.

4. License

Subject to your compliance with these Terms, EasyVitals grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, access, and use the Service for your own lawful personal use.

You may not:

• copy, reproduce, distribute, publicly display, or publicly perform the Service except as expressly permitted;
• modify, adapt, translate, reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Service except to the extent such restriction is prohibited by law;
• remove or alter proprietary notices;
• use the Service to build a competing product or service;
• interfere with or disrupt the Service or related systems;
• bypass or attempt to bypass security, rate limits, or access controls; or
• use the Service in any unlawful or unauthorized manner.

5. Health, Wellness, and Medical Disclaimer

EasyVitals is a consumer wellness and logging tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

The Service, including meal analysis, calorie estimates, macro estimates, weekly recaps, observations, reminders, and other outputs:

• is for general informational and personal wellness purposes only;
• may be incomplete, inaccurate, delayed, or unsuitable for your circumstances; and
• is not a substitute for professional medical advice, diagnosis, treatment, or emergency care.

You should not make medical decisions or delay seeking professional care based on the Service. If you believe you may have a medical emergency, call emergency services immediately and contact a qualified clinician.

6. AI-Assisted Features

Certain Service features use artificial intelligence or machine learning to analyze meal photos, interpret text logs, estimate calories or macros, classify activities, or generate recaps and observations.

You acknowledge and agree that:

• AI outputs are generated automatically and may contain errors, omissions, or misleading results;
• food databases and barcode-derived information may be incomplete or inaccurate;
• you remain solely responsible for reviewing, validating, and deciding whether to rely on any output; and
• EasyVitals may change the underlying AI or inference providers from time to time.

We do not warrant that AI-generated output will be accurate, complete, or fit for any particular purpose.

Additional rights and disclosures relating to consumer health data are addressed in the Consumer Health Data Notice contained in the Privacy Policy.

7. Apple Health and Third-Party Data

If you authorize Apple Health access, the Service may read and write certain health or nutrition categories you approve. You remain responsible for deciding what permissions to grant or revoke.

The Service may also rely on third-party data sources, including Open Food Facts or other external systems. We do not control those third-party data sources and are not responsible for their availability, accuracy, completeness, or legality.

8. User Content

You may submit or create content through the Service, including text, photos, meal logs, notes, feedback, and similar material ("User Content").

You retain ownership of your User Content, subject to the rights you grant in these Terms.

You grant EasyVitals a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, transmit, and otherwise process your User Content solely as reasonably necessary to:

• operate and provide the Service;
• sync your content across devices;
• perform analysis and generate outputs you request;
• maintain security and integrity;
• troubleshoot and support the Service; and
• comply with law.

EasyVitals does not use identifiable Apple Health data, meal photos, meal text, workout text, or other identifiable consumer health data for advertising or model training without separate express consent.

You represent and warrant that:

• you own or control the necessary rights to your User Content;
• your User Content and use of the Service will not infringe or violate the rights of any person or entity; and
• your User Content will not violate applicable law.

9. Acceptable Use

You agree not to use the Service to:

• violate any law, regulation, or third-party right;
• upload malicious code, spam, or harmful material;
• probe, scan, or test the vulnerability of the Service without authorization;
• scrape, extract, or systematically harvest Service data except through authorized export features for your own data;
• impersonate another person or misrepresent your affiliation;
• interfere with another user's use of the Service; or
• use the Service in a way that could damage, disable, overburden, or impair the Service.

10. Privacy

Your use of the Service is also governed by the EasyVitals Privacy Policy. By using the Service, you acknowledge that we may process information as described in that policy.

11. Feedback

If you provide suggestions, ideas, feature requests, bug reports, or other feedback, you grant EasyVitals the unrestricted right to use that feedback without compensation or obligation to you, provided that we remain subject to our Privacy Policy regarding personal information.

12. Export, Sign-Out, and Deletion

The Service may provide certain controls such as export, sign-out, or deletion-related functions. Availability may vary by app version.

EasyVitals does not guarantee that every account-management feature will be self-service in every release. If you need assistance with deletion or data-related requests, contact support@easyvitals.app.

Deletion, where available, generally means deletion or de-identification from EasyVitals' active systems and, where contractually and technically available, instruction to processors to delete related data. Deletion may not be immediate or universal. Some information may persist for limited periods in Apple-controlled systems, CloudKit replication or backup environments, Apple Health, processor logs, security records, short-lived anti-abuse systems, or records retained as required or permitted by law.

You acknowledge that much of the Service's core content is stored on your device or in Apple-managed storage associated with your account, and EasyVitals may have limited ability to guarantee the timing or scope of deletion from those systems beyond requesting or initiating deletion through the available platform mechanisms.

In current versions, deletion of feedback-related records stored in the EasyVitals-controlled CloudKit public database may depend on technical or operational prerequisites in that environment, and EasyVitals does not guarantee immediate or universal deletion of that dataset in every environment.

Signing out is not the same as deletion. Revoking Apple Health permissions is not the same as deleting data that has already been written to Apple Health.

You acknowledge that deleting or signing out may affect access to synced data, locally stored data, Apple Health-linked records, or other Service functionality.

13. Intellectual Property

The Service, including its software, design, text, graphics, interfaces, compilations, trademarks, logos, and other content, is owned by EasyVitals or its licensors and is protected by intellectual property and other laws.

Except for the limited license expressly granted above, no right, title, or interest in or to the Service is transferred to you.

"EasyVitals" and related branding are protected to the extent permitted by law. Apple, Apple Health, HealthKit, iCloud, CloudKit, and Sign in with Apple are trademarks or products of Apple and remain the property of their respective owners.

14. Third-Party Services and Links

The Service may integrate with or contain links to third-party services, products, databases, or websites. Those third parties may have their own terms and privacy practices. EasyVitals does not control and is not responsible for third-party services or content.

Your use of third-party services is at your own risk and may be subject to additional terms.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WITHOUT LIMITING THE FOREGOING, EASYVITALS DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND SYSTEM INTEGRATION.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
• ANY DATA, ESTIMATE, ANALYSIS, OR OUTPUT WILL BE ACCURATE OR COMPLETE;
• DEFECTS WILL BE CORRECTED; OR
• THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EASYVITALS AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF EASYVITALS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID, IF ANY, TO USE THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
• FIFTY U.S. DOLLARS (US$50).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

17. Indemnity

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless EasyVitals and its affiliates, licensors, service providers, and personnel from and against claims, liabilities, damages, judgments, losses, costs, expenses, and fees arising out of or related to:

• your use or misuse of the Service;
• your User Content;
• your violation of these Terms; or
• your violation of any law or third-party right.

18. Suspension and Termination

We may suspend, limit, or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe:

• you have violated these Terms;
• your use poses a security, legal, or technical risk;
• we are required to do so by law; or
• continuing to provide the Service is no longer commercially or technically feasible.

You may stop using the Service at any time.

Sections that by their nature should survive termination will survive, including sections concerning ownership, disclaimers, limitations of liability, indemnity, dispute-related provisions, and feedback.

19. Changes to the Service or Terms

We may modify, suspend, or discontinue any part of the Service at any time.

We may also update these Terms from time to time. If we make a material change, we may provide notice by updating the effective date, posting revised Terms, or using other reasonable means. Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the updated Terms.

20. Dispute Resolution; Governing Law; Venue

Before filing a formal claim, you agree to try to resolve the dispute informally by contacting EasyVitals at support@easyvitals.app and providing a short description of the issue, your contact information, and the relief requested. If we do not resolve the dispute informally within 30 days, either party may pursue a formal claim as provided below.

Unless applicable law requires otherwise, these Terms and any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be governed by the laws of the state identified in the Operator's principal legal notice, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, any dispute that is not subject to arbitration must be brought exclusively in the state or federal courts located in the county and state of the Operator's principal legal notice, and each party consents to the personal jurisdiction and venue of those courts.

If the Operator adopts a separate arbitration agreement, in-app arbitration assent flow, or other dispute-resolution notice, that more specific dispute mechanism will control to the extent permitted by law.

Nothing in these Terms prevents either party from seeking relief in small claims court for qualifying matters or injunctive or equitable relief for misuse of the Service, infringement, misappropriation, data-security abuse, or unauthorized access.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly incorporated by reference, constitute the entire agreement between you and EasyVitals regarding the Service and supersede prior or contemporaneous understandings relating to the subject matter of these Terms.
